Terms of Service

1. Acceptance of Terms

By accessing or using HolyTL;DR ("the Service"), operated by Berry App Labs ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance. We will notify you of material changes via in-app notice.

2. Description of Service

HolyTL;DR is a web application that delivers daily Bible verses with AI-generated paraphrases written in contemporary Gen Z voice. The Service includes personalized verse selection based on your topics and engagement, verse reactions and bookmarking, mood tracking (Vibe Check), streak tracking, and community polls.

3. User Accounts

To use HolyTL;DR, you must create an account using a magic link sent to your email address. Each person may maintain only one account. You are responsible for maintaining the security of your email account and for all activity that occurs under your HolyTL;DR account.

You must provide accurate information during onboarding. You must be at least 13 years old to use the Service.

4. AI-Generated Content Disclaimer

This is important: The Gen Z translations in HolyTL;DR are AI-generated paraphrases created using large language models. They are not official Bible translations, scholarly commentaries, or theological interpretations.

Every Gen Z translation is displayed alongside the original NIV (or applicable) Bible text so you can always reference the source material. Our paraphrases are intended to make scripture more approachable — they are not a substitute for professional spiritual guidance, pastoral counseling, or formal Bible study.

While we strive for accuracy and faithfulness to the original meaning, AI-generated content may occasionally contain imprecise or incomplete paraphrases. If something feels off, refer to the original text.

5. Acceptable Use

You agree not to:

• Use the Service for harassment, hate speech, or any unlawful purpose.
• Scrape, crawl, or programmatically access the Service without our written permission.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Impersonate another person or misrepresent your affiliation with any entity.
• Interfere with or disrupt the Service or its infrastructure.
• Redistribute, republish, or commercially exploit our Gen Z translations without written permission.
• Use automated tools to create accounts or interact with the Service.

6. Intellectual Property

6.1 Our Content

The Gen Z translations, user interface, branding, design elements, and underlying technology of HolyTL;DR are owned by Berry App Labs and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

6.2 Bible Text

Original Bible text displayed in the app is sourced from public domain translations or used under license from the applicable rights holders. Attribution is provided alongside each verse.

6.3 User Content

Any content you contribute (such as poll responses) may be used in anonymized, aggregated form as described in our Privacy Policy.

7. Free Trial

New users receive a 7-day free trial of the full HolyTL;DR experience. No credit card is required to start a trial. At the end of the trial period, your account will automatically revert to the free tier unless you subscribe to Premium.

8. Premium Subscription

8.1 Billing

Premium subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan) through Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle.

8.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will receive a reminder before each renewal.

8.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain Premium access until then.

8.4 Refunds

If you request a refund within 7 days of a payment, we will issue a pro-rated refund for the unused portion of your subscription. Refund requests after 7 days are handled on a case-by-case basis. Contact hello@holytldr.com for refund requests.

9. Church White-Label Program

Churches and faith-based organizations interested in white-label deployments of HolyTL;DR must enter into a separate agreement with Berry App Labs. These Terms do not govern white-label arrangements. Contact hello@holytldr.com for more information.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Berry App Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the Service.

Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Berry App Labs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to conflict of law principles.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Kansas. Each party shall bear its own costs. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service, other users, or Berry App Labs. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and governing law) shall survive.

You may delete your account at any time by contacting hello@holytldr.com.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie & Storage Policy, constitute the entire agreement between you and Berry App Labs regarding the Service.
